These terms of use together with the documents referred to in it tells you the terms of use on which you may make use of our website www.gfinityesports.com, whether as a guest or a registered user. Use of our site includes accessing, browsing and/or registering to use our site.

By using our site, you confirm that you accept these terms of use and that you agree to comply with them. These terms of use form the entire understanding between us.  If you do not agree to these terms of use, you must not use our site.

     6. Services requiring payment of a fee

Our site is generally made available free of charge (except for the Subscription Services). We may sometimes charge a fee for certain services and/or promotional events. If the service you use incurs a fee, you will be able to review and accept terms that will be clearly disclosed prior to you incurring any fee. Our fees are quoted in Pounds Sterling and we may change them from time to time. We will notify you of changes to our fees by posting such changes on our site.

 

  1. Accessing our site

We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. Access to our site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our site without notice. We will not be liable to you if for any reason our site is unavailable at any time or for any period.

You are responsible for making all arrangements necessary for you to have access to our site. 

 

  1. Your account and password

To use certain parts of our site, you must submit a completed registration form to us. We may refuse your application for registration at our discretion. If we accept your application for registration we will confirm this by providing you with a username and password.

We have the right to disable any username or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use (or, acting reasonably, we otherwise have good cause to terminate membership).

You undertake that all information provided by you for the purpose of registering with us is accurate and complete.

 Each registration is for a single user only. You may not share your username or password with any other person nor with multiple users on a network and nor may another user use your account on your behalf.  Your account is for your own personal and non-commercial use.

 You accept sole responsibility for all use of and for keeping secret your username and password. If you know or suspect that anyone other than you knows your username or password, you must promptly notify us

The content on our site (including that provided by third parties), is provided for general information only. It is not intended to amount to advice on which you should rely. You are able to contribute to our site and whilst we encourage you to contribute User Generated Content to our site you agree that when doing so, you will:

(a)      comply with these terms of use (including, without limitation, the Acceptable Use Policy);

(b)      only upload or submit User Generated Content to our site which either you own or which you have the permission of the owner of that material to submit and you must not submit any User Generated Content the intellectual property or other proprietary rights in which are owned by any third party; and

(c)      not submit any User Generated Content which is prohibited by the Data Protection Act 1998 or any other applicable data protection or privacy legislation.

If you submit User Generated Content for display on our site you are responsible for ensuring that such User Generated Content is and remains accurate, complete and up to date and that it complies with these terms of use.

You warrant that you have taken all reasonable precautions to ensure that (i) any User Generated Content that you upload or otherwise submit to our site is free from viruses and anything else which may have a contaminating or destructive effect on any part of our site or any other technology and (ii) that it complies with these terms of use.

We are not obliged to monitor the User Generated Content submitted to our site whether by you or any other user of our site. However, we reserve the right (without limiting our rights to seek other remedies) at any time to remove without notice any User Generated Content or any other content, information or material placed on our site that we consider to be in breach of these terms and of use, to constitute a misuse of our site or which may otherwise be harmful to other users of the site.

You will indemnify and hold us harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising (including without limitation, economic loss) suffered by us arising out of your failure to observe any of the terms relating to User Generated Content.

You shall retain ownership of all copyright in User Generated Content that you submit to our site. When you submit User Generated Content to our site you automatically grant us a world-wide, non-exclusive, royalty-free, non-terminable licence (including the right to sub-licence to third parties) to use, communicate to the public, copy, distribute, publish, play, perform and make adaptations or derivative works of such User Generated Content in any manner and for any purpose whatsoever including, without limitation any commercial or advertising purpose.

You acknowledge that any User Generated Content you submit to any public section of our site will be available to other users of our site. You agree that any other user of our site shall be entitled to use your User Generated Content in accordance with these terms of use and that we shall not be liable for any other use made of Your User Generated Content by any third party.

Our site contains forums to facilitate the sharing of information and networking. Views expressed are solely those of the contributors and we make no warranty as to the accuracy of any statements.

Contributors to forums are reminded to make responsible postings, in accordance with the Acceptable Use Policy. Commercial advertising of services or products is not permitted in forums.

We reserve the right to close the user accounts of persistent offenders. Users of forums are encouraged to report inappropriate postings.

Comments posted in forums may not be published in any form elsewhere – whether reproduced, quoted, or paraphrased – without the prior consent of their originator. Before referring to material contained here in any public domain, please contact the editor for advice.

  1. Viruses

We do not guarantee that our site will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform in order to access our site. You should use your own virus protection software.

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

These terms of use, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law and subject to the exclusive jurisdiction of the courts of England and Wales.

Acceptable use policy

Your use of our site means that you accept, and agree to abide by, all the policies in this acceptable use policy, which supplement our terms of website use.

Prohibited uses

You may use our site only for lawful purposes.  You may not use our site:

  • In any way that breaches any applicable local, national or international law or regulation.
  • In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
  • For the purpose of harming or attempting to harm minors in any way.
  • To send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards (as detailed below).
  • To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
  • To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

You also agree:

  • Not to reproduce, duplicate, copy or re-sell any part of our site in contravention of the provisions of our terms of website use.
  • Not to access without authority, interfere with, damage or disrupt:
    • any part of our site;
    • any equipment or network on which our site is stored;
    • any software used in the provision of our site; or
    • any equipment or network or software owned or used by any third party.

Interactive services

We may from time to time provide interactive services on our site, including, without limitation messaging services (interactive services).

We will do our best to assess any possible risks for users from third parties when they use any such interactive service provided on our site, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks. However, we are under no obligation to oversee, monitor or moderate any interactive service we provide on our site, and we expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards, whether the service is moderated or not.

Content standards

These content standards apply to any and all material which you contribute to our site (contributions), and to any interactive services associated with it.

  • Be genuinely held (where they state opinions).

Contributions must not:

  • Contain any material which is obscene, offensive, hateful or inflammatory.
  • Promote sexually explicit material or be pornographic.
  • Promote violence.
  • Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
  • Infringe any copyright, database right or trade mark of any other person.
  • Be likely to deceive any person.
  • Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
  • Promote any illegal activity.
  • Amount to bullying or internet trolling.
  • Be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience or needless anxiety.
  • Be likely to harass, upset, embarrass, alarm or annoy any other person.
  • Seek to exploit or mislead any other person particularly those under the age of 18.
  • Be used to impersonate any person, or to misrepresent your identity or affiliation with any person.
  • Give the impression that they emanate from us, if this is not the case.
  • Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.
  • Be used for commercial purposes.

Suspension and termination

We will determine, in our discretion, whether there has been a breach of this acceptable use policy through your use of our site.  When a breach of this policy has occurred, we may take such action as we deem appropriate. 

Failure to comply with this acceptable use policy constitutes a material breach of the terms of use upon which you are permitted to use our site, and may result in our taking all or any of the following actions:

  • Immediate, temporary or permanent withdrawal of your right to use our site.
  • Immediate, temporary or permanent removal of any posting or material uploaded by you to our site.
  • Issue of a warning to you.
  • Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
  • Further legal action against you.
  • Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

We exclude liability for actions taken in response to breaches of this acceptable use policy.  The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.

Changes to the acceptable use policy

We may revise this acceptable use policy at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you. Some of the provisions contained in this acceptable use policy may also be superseded by provisions or notices published elsewhere on our site.

Competition Rules

NO PURCHASE NECESSARY TO ENTER OR WIN FREE COMPETITIONS. PREMIUM COMPETITIONS ARE ONLY AVAILABLE TO PREMIUM MEMBERS. A GFINITY MEMBERSHIP IS A REQUIREMENT TO ENTER ALL COMPETITIONS.

 1. Sponsor

These are the Official Rules for the ‘Gfinity Competitions’ The sponsor and administrator of these ‘Gfinity Competitions’ is Gfinity Plc, Unit 11, The Factory, 2 Acre Road, Kingston, Surrey, KT2 6EF (“Sponsor”).

2. Eligibility

The Contest is open to residents of the United States, Canada, EU member states, Switzerland, Australia, New Zealand, Singapore, South Africa, Norway, Channel Islands, Isle of Man and the United Kingdom. Employees of Sponsor, its parent, subsidiaries, affiliates or agencies and suppliers (individually "Entity" and collectively, "Entities") and the immediate family (i.e. spouse, parents, siblings and children) and household members of each Entity are not eligible. Participation constitutes entrant's full and unconditional agreement to these Official Rules and Sponsor's decisions, which are final and binding in all matters related to the Contest. Winning a prize in this Contest is contingent upon fulfilling all requirements set forth in these Official Rules.

3. Timing

The ‘Gfinity Competitions’ run for specific times which can be found on the competition page itself (the ‘Gfinity Competitions’ period). Sponsor’s computer is the official time-keeping device.

4. How to Enter

To enter the ‘Gfinity Competitions’ you must be a registered member of Gfinity. If you are not a registered member of Gfinity, please visit http://www.gfinity.net to register for an account. Registration for and use of Gfinity and other Gfinity applications are subject to Gfinity’s terms and conditions. By entering ‘Gfinity Competitions’, you agree to all of the terms and conditions of Sponsor's Privacy Policy, which is available at http://www.gfinity.net. 

To enter the ‘Gfinity Competitions’:

Entrants must click the ‘enter now’ button for the competitions they which to enter on the Sponsor’s competition page on http://www.gfinity.net/competition.

LIMIT: Limit one (1) ‘Gfinity Competitions’ entry per person, per Gfinity account. Any entry which exceeds this entry limit from the same Gfinity account will be disqualified. Any attempt by a person to enter the ‘Gfinity Competitions’ more than once may result in disqualification at the discretion of the Sponsor. Multiple participants are not permitted to share the same Gfinity account. Normal Internet access and usage charges imposed by your online service may apply. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorised account holder of the Gfinity account used will be deemed to be the registrant or player. The winner may be required to show proof of being the authorised account holder.

On some rare occasions entry mechanics might be different from the ones above (e.g. survey give aways, social media, etc...) in which case these terms also apply.

5. Drawing and Winner Notification

Sponsor will select ‘Gfinity Competitions’ winners in a random drawing of all eligible entries. Odds of winning will be determined by the number of eligible entries received. Sponsor is not responsible for and shall not be liable for late, lost, or misdirected entries.

Sponsor will notify the potential ‘Gfinity Competitions’ prize winner by Gfinity notification sent to the Gfinity account information provided by entrant in the ‘Gfinity Competitions’ entry. It is the entrant’s obligation to notify the Sponsor in writing of any change of contact information. The winner will be required to respond to the winner notification within two days of the time the notice is sent in order to claim his/her prize. If the potential winner cannot be contacted or fails to respond within the required time period or fails to comply with any other term of these Official Rules, that potential winner forfeits the prize. Winning is contingent upon fulfilling all requirements of these Official Rules. In the event that the potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining entries from the applicable Entry Period. 

6. Publicity

The acceptance of the Prize by a winner shall constitute and signify winner’s agreement and consent that Sponsor and its designees may use the winner's full name, county, likeness, quotes, photo, submission, entry or prize information (collectively “Submission”) in any manner the Sponsor deems fit including, but not limited to, in connection with Sponsor’s exploitation of the Submission for promotional, advertising or other purposes, worldwide, in any and all media now known or hereafter devised, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law.

7. Release

By participating, entrant agrees to release and hold harmless the Sponsor and its respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company's officers, directors, employees and agents from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property arising out of entrant’s participation in these ‘Gfinity Competitions’ or receipt or use or misuse of any prize, as well as or any claim or cause of action based on publicity rights, infringement of intellectual property, defamation, or invasion of privacy arising from any materials entrant has submitted in connection with entrant’s participation in the ‘Gfinity Competitions’. 

8. Limitations of Liability

Sponsor is not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilised in the ‘Gfinity Competitions’; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorised human intervention in any part of the entry process or the ‘Gfinity Competitions’; (4) technical or human error which may occur in the offer or administration of ‘Gfinity Competitions’, including but not limited to errors in the advertising, Official Rules, selection and announcement of the winner and distribution of the prizes or the processing of entries; (5) any inability of any winner to accept or use any prize for any reason; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the ‘Gfinity Competitions’ or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the ‘Gfinity Competitions’ provided that, if it is not possible to award another entry due to discontinuance of ‘Gfinity Competitions’ or any part of it, for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims. Sponsor reserves the right to cancel, suspend and/or modify the ‘Gfinity Competitions’ or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the ‘Gfinity Competitions’, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the ‘Gfinity Competitions’ or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the ‘Gfinity Competitions’ may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

9. Entrant's Personal Information

Information collected from entrants in this ‘Gfinity Competitions’ is subject to the Sponsor’s Privacy Policy.

10. Winner

Winners will be announced on the Gfinity website.

 

Fantasy Elite Series Terms and Conditions

By registering to participate in The Gfinity Elite Series Fantasy Game (the ‘Game’), you (‘you’ or the ‘Entrant’) are agreeing to be bound and abide by these Terms and Conditions.  


1. PROMOTION PERIOD

Registration for the Game begins on Friday 4th August 2017 at 00:00.  The Game begins on Friday 11th August 2017 and ends on 20th of August 2017 at 00:00 (the ‘Promotion Period’). Any entries for the Game that are submitted after 20th of August 2017 at 00:00 will score points from the start of the following round.


2. PROMOTER

The Game is operated by GFM Clever Games Limited, a company incorporated in England and Wales under registered number 09150260 and having its registered office at 42 Phoenix Court Hawkins Road, Colchester, Essex, CO2 8JY (the ‘Promoter’).  The Promoter is operating the Game under licence from Gfinity PLC, a company incorporated in England and Wales under registered number 08232509 and having its registered office at 35 New Bridge Street, London EC4V 6BW.

3. ELIGIBILITY

The Game is open to residents of the United Kingdom and all countries where the Game is not prohibited or unlawful except: (i) persons who are under the age of eighteen (18) years as of the date of entry (or such higher age of majority as applicable in accordance with the laws of your country); (ii) employees and agents of Gfinity PLC, the Promoter and/or their respective parent, subsidiary and affiliated companies, and each of their respective advertising/promotion agencies; (iii) anyone involved in the organisation and running of the Game; and (iv) the ‘immediate family members’ of any of the persons set forth in (ii) or (iii) above (and for these purposes ‘immediate family members’ shall mean parents, step-parents, children, step-children, siblings or spouses).
In registering to participate in the Game you confirm that you:
(i) are eligible to do so and eligible to claim any prize that you may win;
(ii) fully and unconditionally agree to and undertake to comply with these Terms and Conditions and any instruction of the Promoter and/or Gfinity PLC in relation to the Game;
(iii)accept that decisions of the Promoter and/or Gfinity PLC regarding all matters relating to the Game are final and binding.
There is a strict limit of a maximum of ‘one team per person' (regardless of the number of email addresses or registered accounts) and ‘one team per email address' (regardless of whether more than one person uses the same email address), both of which will be enforced during the Promotion Period. The Promoter and Gfinity PLC reserve the right to disqualify any Entrant that, in the sole opinion of the Promoter and Gfinity PLC, is suspected of having breached either of these limits.

4. ENTRY AND REGISTRATION

No purchase of any item or service is necessary in order to enter the Game and no payment is required from you to enter the Game. Only entries received in accordance with these Terms and Conditions will be accepted.
To enter the Game, visit https://gfinityesports.com/uk/fantasy/ (the ‘Website’) during the Promotion Period and select the Elite Series Fantasy Game from the on-page game selector. You will then be prompted to register by following all steps on the online entry form until your team is saved.
During the registration process you will be asked to provide your name, email address, nationality and date of birth and to select a username and password.  Any personal information which you submit will be controlled and used in accordance with Section 4 below.  
Entries correctly submitted via the Website will result in an acceptance message on the Website (which Entrants are advised to print out and keep) confirming the Entrant's email address, password and team name (and these details will be confirmed to the Entrant by email).
Neither the Promoter, Gfinity PLC nor any of their employees, agents or representatives shall be responsible for
(i)any actions taken using your password (and you are responsible for the safety and security of your password);
(ii)any entries which are delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
(iii)lost, late, incomplete, damaged, stolen, invalid, unintelligible or misdirected entries, which will be disqualified.
Once submitted, entries become the sole property of Gfinity PLC and the Promoter and will not be acknowledged or returned. The Promoter's computer record of the entry will be considered to be the official entry. In the event of a dispute as to any entry, the authorized account holder of the email address used to register will be deemed to be the Entrant


5. PERSONAL INFORMATION

By entering the Game, you agree that any personal information provided by you with your entry to the Game shall be:
(i)controlled in accordance with Gfinity PLC’s current published Privacy Policy (click here: https://gfinityesports.com/uk/policy to view); and
(ii)used by the Promoter, Gfinity and their respective agents and suppliers to administer the Game, send out prizes and to enable the Promoter and Gfinity PLC to promote the Game in any media (including, without limitation, television and online broadcast, publishing channels and on Gfinity PLC’s and its partners’ social media pages).


6. HOW TO PLAY THE GAME

The Game will be governed by the rules set out in this Section 6 from time to time published on the Website. The Promoter and Gfinity PLC reserve the right to alter, amend or supplement these rules from time to time in their absolute discretion in the event of any circumstances beyond its reasonable control arising or where it considers it desirable to do so. You agree that no liability shall attach to the Promoter or Gfinity PLC as a result of any such change and so are advised to check these rules regularly from time to time.
General: The Game relates to matches forming part of the Gfinity Elite Series (the ‘Tournament’). There are three different forms of the Game available to play:

  • Counter Strike: Global Offensive (CS:GO);
  • Street Fighter V (SFV); and
  • Rocket League (RL).

The objective of the Game is to accumulate the most points (see ‘Scoring Points’ below) over the course of the Promotion Period.  Entrants must select a team of 6 (six) players from the player list (with a maximum of 4 (four) players from any one team).  
To ensure the Game remains competitive, each player has been assigned a value between 2 and 10. Your team of 6 (six) players must have an aggregate value of not more than 40.

To be eligible to score points for a match, your selections must be submitted prior to the relevant deadline by which you must have registered players as part of your team in order to qualify for points for the relevant match, as published by the Promoter from time to time on the selection page.  Player points scored from matches played earlier in the Tournament will not be added retrospectively.
Transfers: Up until the start of the Tournament on https://gfinityesports.com/uk/fantasy/ you can make unlimited transfers to your team for free. During the Tournament, you may make up to three transfers between each round of matches.
The transfer deadline is the scheduled start of the first match in each round of matches. Transfers made after this time will not become active until the following match. Unused transfers will not roll over.
You can make an unlimited number of Power Player (see ‘Scoring’ below) changes during the Tournament.
Team Names: The Promoter and Gfinity PLC reserve the right to refuse to accept team names that are felt in their sole opinion to be inappropriate or offensive. Unsuitable names will be deleted and the team will appear under the Entrant's name.  Notwithstanding the foregoing, the Promoter and Gfinity PLC reserve the right to delete the account of an Entrant who breaches this requirement without notice. Any such decision to do so by the Promoter or Gfinity PLC is final.

Power Players: Entrants must select a ‘Power Player’ for each match during the Game. Their designated Power Player will have their match score doubled (regardless of whether the points scored are positive or negative).  

Player List: The players included on the player list and their positional classifications have been determined by Promoter and Gfinity PLC  Neither party will enter into any correspondence relating to details of the player list, nor will they accept the inclusion into a team of any player not on the published list, although players may be added during the Game. Player values are fixed, and will not change throughout the Tournament. 

Accuracy: The Promoter and Gfinity PLC will make all reasonable efforts to ensure that the Game is available to you and that the information relating to the Game on the Website is correct and accurate (and to update such information on a regular basis), but do not guarantee that this will be the case at all times.  Neither the Promoter nor Gfinity PLC are responsible for any unavailability of or interruptions to any service or equipment used in connection with the Game, including, without limitation, (1) interruptions to any network, server, Internet, website, telephone, satellite, computer or other connections (2) failures of any telephone, satellite, hardware, software or other equipment, (3) garbled, misdirected or jumbled transmissions, or traffic congestion, or (4) other errors of any kind, whether human, technical, mechanical or electronic, or (5) the incorrect or inaccurate capture of entry or other information or the failure to capture any such information.

Decisions: The Promoter and Gfinity PLC will be the sole decision-makers of any matter of interpretation relating to the Game and any aspect of the content of, or playing of, the Game. 

Neither the Promoter nor Gfinity PLC will enter into correspondence relating to such matters and their decision(s) as to any matter arising out of or in connection with the Game (including but not limited to the allocation of points to any player and/or the award of any prize and/or any ranking or league table) shall be final and conclusive.


7. PRIZES

From all eligible entries received, the overall winner, runner-up and third place prizes will be awarded to the Entrant who, according to the Promoter and Gfinity PLC’s determination, are in the top three places of the leaderboard at the end of the Tournament.  In addition, a weekly winner prize will be awarded to the Entrant who, according to the Promoter and Gfinity PLC’s determination, accumulated the most points in each weekly period.

The prizes for each of the categories of winner are as follows:

Overall Winner

  • £350 cash;
  • Two tickets to the Gfinity Elite Series Season Two Finals (does not include travel and accommodation);
  • Two Scuf Controllers;
  • Astro Gaming headphones;
  • GTO Gaming chair; and
  • Gfinity goody bag: t-shirt, mug, water bottle, stress ball, pen and key ring (items may vary).

Runner-up

  • £200 cash;
  • Two tickets to the Gfinity Elite Series Season Two Finals (does not include travel and accommodation);
  • Two Scuf Controllers;
  • Astro Gaming headphones;
  • GTO Gaming chair; and
  • Gfinity goody bag: t-shirt, mug, water bottle, stress ball, pen and key ring (items may vary).

3rd Place

  • £100 cash;
  • Two tickets to the Gfinity Elite Series Season Two Finals (does not include travel and accommodation); and
  • Gfinity goody bag: t-shirt, mug, water bottle, stress ball, pen and key ring (items may vary).

Weekly Winner

  • £30 cash;
  • Announced as Manager of the Week online;
  • Two tickets to the Gfinity Elite Series Season Two Finals (does not include travel and accommodation); and
  • Gfinity goody bag: t-shirt, mug, water bottle, stress ball, pen and key ring (items may vary).

Prize Notification: Prize winners will be notified via email (using the email address provided during registration) sent within 30 days following the end of the Tournament.  It is the sole responsibility of the Entrant to notify the Promoter during the Tournament if his or her e-mail address has changed. To do so, click on the ‘Contact’ link on the Website, then follow the instructions. Prizes will be awarded in accordance with the details set out above and in the Prizes page, as amended from time to time.  If no response is received after the Promoter has made reasonable efforts to make contact and within a reasonable period of time, or a winner declines to accept the prize, the Promoter reserves the right to withdraw prize entitlement and award the prize to the next highest scorer. Any prize which is returned or cannot be delivered may be used for another competition or given to charity. Neither the Promoter nor Gfinity PLC will have any responsibility to anyone who has not responded.  Winners are solely responsible for any and all expenses, relative to participation in the Game (including acceptance of any prize) not specified herein.

Substitution; Taxes: Prizes are subject to availability and the Promoter and/or Gfinity PLC reserve the right to substitute a prize with one of comparable value or greater value. The winner is solely responsible for all local, federal and state taxes associated with the receipt of a prize.  Prizes awarded in the form of gift cards can only be used for future purchases at the location stated on the gift card. Gift cards are NOT redeemable/exchangeable for cash. Other restrictions may apply. 

Prize Delivery: Prize winners should allow up to 60 days following the final match of the Tournament to receive their prize.   

Publicity: the winners' names, photographic images and their comments relating to any prize may be used without limitation for future promotional, marketing and publicity purposes of the Promoter and/or Gfinity in any and all media worldwide without notice to them and without any fee being paid and, in participating in the Game, all entrants consent to the same.

No Warranty: Entrants acknowledge that the Promoter, Gfinity PLC and their respective agencies or related companies have not made nor are in any manner responsible for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality. The terms and conditions of any third party supplier may apply to a prize as indicated. 

Eligibility: Winning a prize is contingent upon fulfilling all requirements set forth herein.  Only Entrants who are entitled under local laws to receive a prize and who reside in countries where the Game is not prohibited or restricted by law will be eligible to win a prize. Gfinity PLC reserves the right to request proof of identity and/or to verify eligibility conditions before awarding any prize.  Neither the Promoter nor Gfinity PLC accepts any responsibility if you are not able to take up the prize. 

The Game is void where prohibited or restricted by law and subject to all applicable local, state, federal and municipal regulations.


8. CONDITIONS OF PARTICIPATION

Entrants shall not attempt to make contact with any players or player support personnel participating in the Tournament in relation to the Game, and shall not otherwise attempt to access non-publicly available information about team selection or strategy for the purposes of their participation in the Game. 

The Game is strictly for entertainment purposes and may not be used in connection with any form of gambling. 


9. CANCELLATION OR DISQUALIFICATION

The Promoter and Gfinity PLC reserve the right, in their sole discretion, to modify, cancel, terminate, and/or suspend the Game and to disqualify any individual who tampers with the entry process, violates these Terms and Conditions, or acts in a disruptive or unsportsmanlike manner which contravenes the spirit of the Game and/or these Terms and Conditions. Without limiting the foregoing, the Promoter and/or Gfinity PLC may suspend or delete the account of an Entrant who, in their sole judgment, has been disqualified or is otherwise ineligible to enter. 

Without limiting the foregoing, the Promoter and/or Gfinity PLC may modify, cancel, terminate, and/or suspend the Game if, in the sole opinion of the Promoter and/or Gfinity PLC an incident of any kind occurs to corrupt or impair the administration, security, integrity, fairness or play (as intended) of the Game, including without limitation: (a) viruses, bugs, unauthorized human intervention, fraud or technical failure;  (b) earthquake, flood, fire, storm or other natural disaster;  (c) act of God; or (d) labour controversy or threat thereof, civil disturbance or commotion, disruption of the public markets, war, armed conflict or terrorism (whether actual, perceived or threatened). In the event that the Tournament is postponed, terminated early, or cancelled for any reason, the Promoter and/or Gfinity PLC reserve the right to award prizes based on scores at the time the Tournament is disrupted, or to cancel, modify or suspend the Game at its discretion. In the event of a cancellation or termination by the Promoter or Gfinity PLC, the Entrant who has accumulated the highest point total (and who wins any pending tiebreakers) at the time of any said action will be awarded the prizes, or the prizes will be awarded in such other manner deemed fair and appropriate by the Promoter. 


11. LIMITATIONS OF LIABILITY

The Promoter and Gfinity PLC do not make any representation, warranty or guarantee, express or implied, relating to the Game or prizes, and are not responsible for: (1) any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment, hardware, software or programming associated or used with the Game; (2) technical errors, defects, delays or failures of any kind, including without limitation malfunctions, interruptions or disconnections in communications lines, Internet or website access, hardware or software; (3) digital or electronic disruptions, e.g., viruses; (4) unauthorized human intervention, e.g., hacking; (5) technical or human error which may occur in connection with any aspect of the Game; (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant's participation in the Game, access to, copying or downloading materials from the Website or any other website, or receipt or use of any prize (save to the extent such injury or damage occurs as a result of the negligence of the Promoter, Gfinity or any of their employees). Entrants' legal rights as consumers are not affected. 

If there is any reason to believe that there has been a breach of these Terms and Conditions, the Promoter may, at its sole discretion, reserve the right to exclude any Entrant from participating in the Game.

Gfinity PLC and the Promoter accept no responsibility whatsoever for anything that may be published on any area of the Game where user-generated content may be posted. 

If any of these Terms and Conditions are determined to be illegal, invalid, or otherwise enforceable then the remaining terms shall continue in full force and effect.


12. COPYRIGHT

These Terms and Conditions and all material within the Game are the copyright of Gfinity PLC. No information may be reproduced in any format without prior written consent from the Promoter. 


13. GOVERNING LAW

The interpretation of these Terms and Conditions (including any non-contractual obligations arising from or connected with the Game) shall be governed exclusively and in all respects by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
